Privacy Statement for the Pixum Mobile Apps

1) General handling of collected data

Pixum respects your privacy. All collected data serves the improvement of our offer. Data protection and data security for customers and users have the highest priority for Pixum. The protection of your personal data during our entire business processes is therefore of particular concern to us. In accordance with article 13 of the General Data Protection Regulation (EU GDPR), this privacy statement explains which information and data is collected and how this information is used after you have used the Pixum apps.

We use the information you provide to fulfill and process your order. Your data will be used in accordance with the applicable data protection regulations solely for the purpose associated with the respective collection and to safeguard our own legitimate business interests. Therefore, we only collect data which is necessary for the problem-free handling and improvement of our business processes and above all for the processing of your order.

Our applications contact our servers for various purposes. This is necessary, for example, when selecting a trading partner, when requesting and updating price information or in the case of an order. Access data such as the current IP address of your access, the date and time of your visit are temporarily stored on our servers. This data will be deleted after 7 days at the latest.

When registering, logging in or ordering, data such as username, password, address, and order information is transferred via an Internet connection. This is done exclusively through encrypted connections. This data is also stored on Pixum's secure servers.

In order to protect your data, no personal data is stored by default in our ordering software. However, you have the option of saving your user name and password in the applications in order to be able to log in easily. You have the option of selecting this function.

2) Processing of payment data

The electronic payment process is processed by our certified payment service provider, Computop Wirtschaftsinformatik GmbH. During payment, your payment data will be exchanged directly between you and our payment service provider and will only be stored with them for a limited period of time for the purpose of payment processing and for any complaints or refunds.

To make payment easier for you, you can have your payment data stored for the future during a payment process and reuse it for future orders. In this case your payment data will be stored indefinitely and you only have to confirm your payment data during the next payment process.

3) Processing of image and ordering information

When placing an order, the uploaded image and order data will be stored and processed on Pixum's servers for the purpose of manufacturing your photo products. After your order has been completed and delivered to you, the image data will be kept in the manufacturing database for up to 12 weeks in order to process any complaints or repeat orders. After that the data is permanently deleted.

Pixum hires external companies and individuals to carry out certain services, such as packaging, shipping, and delivery of products. These service providers have access to personal information required to perform their services. However, they may only use this information for said purposes. We have obligated our service providers to treat the information in accordance with the relevant data protection laws and our privacy statements.

Personal data will only be transferred to government agencies within the framework of mandatory legal provisions. Your data will not be disclosed to private third parties without your express consent.

4) Data transmission via the Pixum Apps

In our apps, a campaign evaluation is carried out with which we can identify the channels through which customers were acquired. All data of the campaign evaluation are collected in a pseudonymised manner and statistically evaluated by the Adjust GmbH. You can turn it off at any time. In this case, no campaign evaluation is performed in the applications and all data collected so far will be deleted immediately. Of course, we take into account the guidelines set globally on your device.

To make the usability of our apps easier for you, we request access to e.g. location information and your address book. This information will not be used for purposes other than those listed below. This data is neither stored by us nor statistically evaluated. Access to your address book is requested by the apps so that you can use the addresses of your personal contacts as delivery addresses.

a) Pixum Photo World App:

To improve our service, certain events are recorded in the applications, such as transmission errors when an order is being uploaded. The recorded events are transferred to Adobe System Inc. pseudonymously for the purpose of statistical evaluation. You can deactivate the event counting and transmission at any time.

c) Pixum Phone Case App:

To improve our service, certain events are recorded in the applications, such as transmission errors when an order is being uploaded. The recorded events are transferred to Google LLC pseudonymously for the purpose of statistical evaluation. You can deactivate the event counting and transmission at any time.

d) Pixum Photo Calendar App:

To improve our service, certain events are recorded in the applications, such as transmission errors when an order is being uploaded. The recorded events are transferred to Google LLC pseudonymously for the purpose of statistical evaluation. You can deactivate the event counting and transmission at any time.

d) Pixum App:

At the first level, the personal data (e.g. name and address) necessary for the smooth order are being processed in the Pixum App. To make the ordering process as easy and quick as possible for you, your selected images will be uploaded in the background already during the design session. This helps us to reduce the waiting time during the upload process to a minimum. During the order completion, the recorded order data is safely transferred to our secure server and stored there.

In order to improve our offer, special events are recorded in the applications, e.g. transmission errors when uploading an order. The recorded events are anonymously transmitted to Mixpanel Inc. for statistical evaluation. You can switch off the counting and transmission of events at any time.

When registering for Push Notifications via the Pixum App, your Push Token will be used for your own information and advertising purposes. When the push notifications are displayed and you interact with them, information is automatically collected and evaluated which helps Pixum to continuously improve your user experience and to make it personal and relevant for you. The user-related evaluation and profile creation uses information such as receipt and read confirmations of push notifications, date and time of the visit to the Pixum App as well as purchases made by you based on this information. Pixum uses this information exclusively in pseudonymised form. By evaluating this data, Pixum aims to make advertising more useful and interesting for you. You can unsubscribe at any time and without giving reasons by using the system settings of our app.

5) Contact with the customer service

Should you contact us per e-mail, via the contact form or on the phone, the personal data you provide us with will be processed. The data that you send us when you contact us will be used only to process your request, including the possibility of contacting you for this purpose.

In case of contact through the virtual assistant, we use third parties to collect information about you on our behalf.

Technical data: Should you contact us via the Pixum app, the technical data on your device such as the phone model and operating system (version) will be collected.

Legal basis for the processing of these data is Art. 6 par. 1 letters b) and f) GDPR.

6) Note on data transfer to third party countries

To ensure the high reachability of our customer service we are supported by service providers outside the area of application of the EU GDPR. We have established contracts on the basis of EU standard contractual terms with the service providers and regularly ensure that our strict data protection requirements are fully complied with.

7) The EU General Data Protection Regulation (EU GDPR) grants you certain rights when it comes to the processing of your data:

  1. Right of access (Article 15 EU GDPR):

    You have the right to obtain confirmation as to whether or not personal data are being processed, and, where that is the case, to access the personal data and the information listed in article 15 EU GDPR.

  2. Right to rectification and right to erasure (?right to be forgotten?) (Article 16 and 17 EU GDPR):

    You have the right to obtain the rectification of inaccurate personal data. Taking into account the purposes of the processing, you also have the right to have incomplete personal data completed. You further have the right to obtain the erasure of personal data, where one of the grounds apply, which are listed in article 17 EU GDPR, e.g., if the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed.

  3. Right to restriction of processing (Article 18 EU GDPR):

    You have the right to obtain a restriction of processing where one of the grounds apply, which are listed in article 18 EU GDPR, e.g., if you contest the accuracy of the personal data, for a period enabling us to verify the accuracy of the personal data.

  4. Right to data portability (Article 20 EU GDPR):

    You have the right to receive your provided personal data in a structured, commonly used and machine-readable format. You also have the right to transmit those data without hindrance. This is the case, if one of the grounds apply, which are listed in article 20 EU GDPR in detail.

  5. Right to object (Article 21 EU GDPR):

    You have the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on point (e) or (f) of Article 6(1), including profiling based on those provisions. We shall no longer process the personal data unless we demonstrate compelling legitimate grounds for the processing which override the interests, rights, and freedoms of the data subject or for the establishment, exercise or defense of legal claims.

  6. Right to lodge a complaint with a supervisory authority (Article 77 EU GDPR):

    You have the right to lodge a complaint with a supervisory authority, in particular in the Member State of his or her habitual residence, place of work or place of the alleged infringement if the data subject considers that the processing of personal data relating to him or her infringes this Regulation.

8) Note on advertising via e-mail

1) E-mail: Collection, processing and use of your personal data:

When registering for the newsletter, your e-mail address will be used for our own advertising purposes. After registration, you will receive an e-mail with a confirmation link. By clicking on this link you complete the registration. You can unsubscribe at any time and without giving reasons. If you no longer wish to receive our newsletter, you can unsubscribe at any time by clicking on the unsubscribe link included in every mailing or by sending an e-mail to service@pixum.com. In the course of displaying the newsletter and clicking links from the newsletter, information is automatically being collected and evaluated which helps Pixum to continuously improve your shopping experience and make it customized and relevant for you. The user-related evaluation and profiling makes use of information such as receipt and read confirmations of e-mails, clicks on links within an e-mail, date and time of the visit to the homepage as well as products viewed by you. Pixum uses this information exclusively in pseudonyms form. By evaluating this data, Pixum pursues the goal of making advertising more useful and interesting for you. If you wish to object to the collection of the above-mentioned data, please send your objection to service@pixum.com.

2) Product recommendations per e-mail:

Regardless of your newsletter subscription, you will receive product recommendations of our own, similar products via e-mail after you have purchased a Pixum photo product. We strictly follow the legal requirements. (Advertising by e-mail according to § 7 para. 3 Unfair Competition Law) You naturally have the possibility to reject our product recommendations at any time and without giving reasons, without incurring any costs other than the transmission costs according to the basic rates. Please send your objection to service@pixum.com or alternatively use the unsubscribe link in our e-mails.
